The Senior Managers & Certification Regime (SM&CR) will apply to all FCA-regulated firms from 9 December 2019.
At first glance, it would appear, that the FCA has minimised the SM&CR obligations for most firms which could reduce the regulatory burden. However, what we will do is help you to look below the surface of SMCR and consider some of the practical implications, particularly the duty of responsibility and personal liability that senior managers will be required to take on. Given some of the challenges we have seen, and the FCA has commented on, in respect of the implementation of the Certification Regime and the added burden of performing an annual ‘fit and proper’ assessments, we will also look to explore some of the key challenges.
